GENERAL TERMS AND CONDITIONS OF SALE

Downloadable Modules

1. Subject and Scope

These General Terms and Conditions of Sale (hereinafter "GTC") apply to any sale of downloadable modules offered by ADAMAS GROUP SA (hereinafter "the Provider") on the website https://www.wepresta.shop (hereinafter "the Site").

These GTC govern the relationship between the Provider and the buyer (hereinafter "the Client"). By placing an order, the Client unreservedly accepts the entirety of these terms.

2. Products and Services

The Provider markets downloadable modules (educational resources, tools, templates, software, etc.) which are digital products delivered in electronic format.

Descriptions, images, and prices of the products are provided for informational purposes. The Provider reserves the right to modify the content or availability of products without prior notice.

3. Conditions of Access to the Site

The Client guarantees:

  • To be of legal age and possess the legal capacity to make purchases
  • To use the Site in accordance with Swiss law and applicable legislation
  • Not to use the Site for illegal or fraudulent purposes

4. Order and Validation

Orders are placed online via the Site's purchase form. The Client must provide the requested information (name, email address, billing details).

An order confirmation is sent to the Client by email after payment validation. The Client must check the details of their order and immediately report any errors.

Any imprecise or incomplete order may be canceled or suspended by the Provider.

5. Price and Payment

Prices displayed on the Site are in Swiss Francs (CHF) and include applicable VAT. The Provider reserves the right to change its prices at any time. Modified prices will apply only to orders placed after the modification.

Payment is made by:

  • Credit card (Visa, Mastercard, American Express)
  • Bank transfer
  • PayPal or other digital wallets
  • Any other means accepted by the Provider

Payment is secure. The Provider does not store Clients' banking data. The Client is solely responsible for the confidentiality of their identifiers and payment codes.

6. Delivery of Digital Products

Downloadable modules are considered delivered as soon as the Client receives access via email or through their user account on the Site, generally within 24 hours following payment confirmation.

The Client is responsible for downloading and backing up the files. The Provider is not responsible for data loss or the inability to download attributable to the Client.

In the event of payment default, product delivery will be suspended until the payment is regularized.

7. Right of Withdrawal

In accordance with Swiss consumer protection law, the Client benefits from a 14-day right of withdrawal from the date of receipt of the product.

However, this right does NOT apply to digital products and downloadable modules once they have been downloaded or once access has begun. The Client has a cooling-off period before downloading.

To exercise a right of withdrawal before downloading, the Client must send a written request to the Provider within 14 days of the order confirmation, by email to mail@wepresta.shop.

The refund will be made within 30 days of receiving the request, using the same payment method as the one used for the purchase.

8. Intellectual Property and License Rights

Downloadable modules are protected by the Provider's copyright and intellectual property rights. The Client acquires a personal, non-transferable, and non-exclusive license to use the product for personal use only.

The Provider reserves the absolute right to deactivate, delete, modify, or revoke access to any downloadable module at any time and without notice, particularly in the event of non-compliance with the license terms, violation of these GTC, or for any reason deemed relevant by the Provider.

The Client agrees not to:

  • Reproduce, copy, or duplicate the modules without authorization
  • Resell, rent, or share the products
  • Modify or create derivative works
  • Distribute the product publicly

Any breach of these obligations, including reproduction, distribution, removal of the license, or unauthorized use in any way, will result in the Client's civil and criminal liability. The Provider reserves the right to initiate any legal action, including criminal and civil prosecution, to punish any violation of these intellectual property rights. The Client will be responsible for legal fees, damages, and all costs related to legal proceedings.

9. Warranty and Liability

The Provider guarantees that downloadable modules are free of viruses and malware at the time of download.

The Provider cannot be held responsible for:

  • Incompatibility between the modules and the Client's equipment
  • Indirect damages, loss of data, or loss of profit
  • Misuse or non-compliant use of the products
  • Interruptions or malfunctions of the Site

The total liability of the Provider to the Client is limited to the amount paid for the order in question.

10. Personal Data Protection

The Provider collects and processes the Client's personal data (name, email address, postal address) in accordance with the Federal Act on Data Protection (FADP) and the revised Federal Act on Data Protection (nFADP).

Data is used exclusively for: order delivery, customer follow-up, commercial communications, and Site improvement.

The Client has the right to access, rectify, and delete their personal data. To exercise these rights, the Client must send a written request to mail@wepresta.shop.

The Provider never transmits the Client's personal data to third parties without their consent, unless required by law.

11. Modifications to the GTC

The Provider reserves the right to modify these GTC at any time. Modifications will take effect upon their publication on the Site. The Client is responsible for regularly consulting the GTC.

12. Assistance and Support

The Provider offers technical support for download or module access issues. The Client can contact support by email at mail@wepresta.shop.

Technical support responds within 48 business hours. Longer delays may apply in the case of complex problems.

13. Applicable Law and Jurisdiction

These GTC are governed by Swiss law, without application of its conflict of law rules.

For disputes relating to the execution or interpretation of the GTC, the parties agree first to seek an amicable resolution.

Failing an amicable agreement, any dispute will be submitted to the competent Swiss courts. The competent jurisdiction will be that of the canton of Geneva, the registered office of the Provider.
